The Iowa Court of Appeals has ruled that the city of Dubuque is responsible for the upkeep of Linwood Cemetery, after years of struggle over how the property should be funded. The appeals court affirmed a district court decision in a lawsuit involving the city of Dubuque, Dubuque County, Dubuque and Julien townships and Linwood Cemetery Association over which entity is responsible to care for the cemetery. Iowa District Court Judge Monica Zrinyi Ackley last year granted a motion to dismiss Dubuque County and the two townships from the litigation, leaving the city responsible for levying taxes necessary to cover Linwood Cemetery costs beyond what cemetery revenues cover.
