An eluding charge levied against a southwest Wisconsin woman was recently dismissed due to an unavailable witness. 31-year-old Danielle M. Kruser of Cuba City was charged in Iowa District Court of Dubuque County with eluding — second or subsequent offense, but the charge recently was dismissed by District Court Judge Thomas Bitter. Court documents state that prosecutors filed the motion for dismissal after they “reviewed the evidence in this matter and determined that (the state) cannot meet its burden without the testimony of an unavailable witness.” Court documents allege that Kruser evaded police through Dubuque on Aug. 26, 2023; ran at least three stop signs; and drove down residential streets at least double the 25 mph speed limit.
