Wisconsin Attorney General Josh Kaul is joining a lawsuit that seeks to block DNA testing company 23andMe from selling genetic information during bankruptcy proceedings. The company filed Chapter 11 bankruptcy in March and is looking to sell its assets, which Kaul said includes genetic data of about 15 million customers. Kaul and 27 other attorneys general are suing to block the sale. The attorneys general argue 23andMe needs to obtain each individual customer’s consent before selling personal information like DNA data, health-related traits and medical records. A federal court in April laid out several procedures for 23andMe’s sale process including requiring bidders to guarantee compliance with the company’s privacy policies and applicable laws. The company is requiring bidders to submit “detailed descriptions” of how they plan to use any data they intend to buy, and must detail their privacy programs and security. 23andMe is also barred from accepting offers from bidders with controlling investments in certain countries including China, North Korea, or Russia.
