A Prairie du Chien couple should learn this week if the state Supreme Court will hear a wrongful-death suit regarding their son’s drowning. Kurt and Rachael Warrington lost their 4-year-old son in 2017 when he was found unresponsive during a swimming lesson. They sued the city and school district in Prairie du Chien arguing staff was negligent in the supervision of their son. A circuit court judge ruled in favor of the city and school last year – citing a “recreational immunity” statute. That rule limits a property owner’s liability for injury caused to a person engaging in recreational activity on the owner’s property. The Wisconsin Court of Appeals agreed with the circuit court ruling. The state Supreme Court is expected to announce a decision by Friday if they’ll take the case.
