Former Milwaukee County Judge Hannah Dugan returned to court Wednesday seeking to overturn her December federal conviction for obstructing an immigration enforcement action. Wednesday’s hearing centered on U.S. District Judge Lynn Adleman’s instruction to the jury on the meaning of the word “proceeding”. Dugan’s lawyers argued that a Virginia appeals court ruling in April states that carrying out an ICE arrest is law enforcement activity and not an official federal proceeding under the obstruction statute. Prosecutors countered by saying the Virginia ruling has no standing in Wisconsin, and that ICE was acting within an ongoing Department of Homeland Security removal proceeding, making it a valid case.
